Equitable opportunity and access to health and care were lacking in the procedure of a disabled persons’s pass. Gleiche Chance und gleicher Zugang zu Gesundheit und Versorgung waren im Verfahren um den Schwerbehindertenausweis nicht vorhanden.
While people with known disease get their degree of disability automatically, it is researched that a person with a rare disease will face disadvantages. In this case the authority charged a family doctor to judge a rare disease who had clearly no knowledge of it. And thus gave a false expertise. Both are sued on the basis of the Berlin Antidiscrimation law, breach of duty for authorities, of public liability and because of the violation of personal rights.
Während Personen mit bekannten Erkrankungen automatisch den Schwerbehindertenausweis erhalten, erleiden Personen mit Seltenen Erkrankungen ausweislich Studien hier Nachteile. Im vorliegenden Fall beauftragte das Versorgungsamt zur Beurteilung einer schweren seltenen genetischen Erkrankungen eine Hausärztin, die deutlich ersichtlich überhaupt keine Ahnung von der Erkrankung hatte. Und ein falsches Gutachten abgab. Beide werden nun verklagt, auf Basis Landesantidiskriminierungsgesetz, der Pflichtverletzung (Amtspflicht) und auf Schadensersatz wegen Persönlichkeitsrechtsverletzung u.A..

To judge the adaequate care for a disabled persons pass because of a severe complex genetic rare disease the relief organisation of Berlin called a family doctor who did nothing about the rare disease, did not know the symptoms, implications or how to measure. She could not explain why she would ignore the medical literature on this rare disease, Nor she could explain, why she denied the care of the symptoms which are given to diseases listed in the national care guideline. According to her, the severe rare disease would not cause problems, belittling it by labeling as a psychological problem. And thus was not even incapable of judging the right care but tried to belittle the complex rare genetic disease, giving a false expertise.
Before, at social court during the law suit for the adequate care (that gives an idea how many law suits a rare diseaser have to fight to realize his right), the plaintiff presented a privately paid expertise. The opposite party acknowledged this and agreed to give the demanded disabled peoples pass. Still in dispute is who pays for this expertise and the travel costs because that this specialist was not found on the spot. And thus the relief organization who has not found a specialist in Berlin itself and who has accepted the findings of this privately organised examination, still refuses to replace these costs.
In the Abstract of “Dignity not fully upheld when seeking health care: experiences expressed by individuals suffering from Ehlers-Danlos syndrome (EDS)” one can read “Aim: The principle of human dignity has assumed importance in ethics and constitutional law throughout the 20th century in the Western world. It calls for respect of each individual as unique, and of treating him or her as a subject, never as a mere object. As such, the principle constitutes an ethical cornerstone in health care. Patients suffering from Ehlers-Danlos syndrome (EDS) challenge medical care and knowledge in health-care professionals’ as symptoms sometimes are vague. Individuals with this disorder have reported not being respected when seeking health care…. Results: After qualitative content analysis, the following five categories were identified: ‘Being ignored and belittled by health-care professionals,’ ‘Being assigned psychological and/or psychiatric explanations’, ‘Being treated and considered merely as an object’, ‘Being trespassed in one’s personal sphere’ and ‘Being suspected of family violence’. Consequences of these encounters were ‘Mistrusting the physician’ and ‘Risking bad health’. Conclusions: The memory of not being respected is substantial for individuals with EDS and can last for years. As a result, lack of trust for the health-care system is created and they may experience difficulties in future encounters with health care. As it not unusual that ist is tried to keep persons with a rare disease out of the care system to save money by calling non experts which give false expertises. The aim of these court cases, is to get final judgements, that the authority has to appoint a specialist on the rare disease in question, and that doctors will not issue false expertises. It is an aim that there will be a compensation the violation of personality rights.
Nicht selten wird versucht, Personen mit Seltenen Erkrankungen aus der Versorgung herauszuhalten und nicht angemessen zu versorgen, um Geld zu sparen. Hierzu werden Gutachter beauftragt, die fachlich nicht kompetent sind und falsche Gutachten abgeben. Ziel ist, solche Verfahren in Zukunft zu unterbinden, indem über ein Urteil ein solches Verhalten schadensersatzfähig ist.

Es gibt noch einen Pkh Antrag auf Basis des Landesantidiskriminierungsgesetzes, da der gleiche Zugang zur Versorgung verweigert wurde (https://germany-disabled-poor-outlawed.de/antidiscrimination-berlin-law-and-judges-exclude-rare-diseaser/), es wird versucht die beiden zu verbinden, um zu klären, ob wegen beiden Rechtsverhalten Schadensersatz besteht, hilfsweise zu entscheiden, aus welchem sich ein Anspruch ergibt.
